i received a deposition notice and have to appear this week. i am pro per and will not have an attorney with me. i read somewhere that you can have someone go with you as long as they so not say anything or interfere or discuss the case with you. My cousin was a witness at the scene of the accident that resulted in my injury from falling merchandise at a warehouse type store.

question #1: could she go to the deposition with me? if she can
legally go with me, is there any other reason i
should be aware of that would make her going
with me a bad idea for other reasons?

the deposition is being held at the defendant's lawyers office which is about 65 miles from my house. my injury involves my back, leg, foot and i have not driven in a car more than 20 miles in the past 18 months because it is too uncomfortable to be sitting in a car that long. the degree of pain and discomfort varies day to day unpredictably. for the past day or two i have been having a very painful time. if i had this type of pain on the day of the deposition i would have a hard time getting there and be ready to be deposed for 8 hours.

question #2: i am hoping for the best, but what if i just can't get there that day, making that drive, etc.? what do i do?

question #3: i saw somewhere that they can make you go up to 75 miles for a deposition, so i guess that means i have to make it there some how? any other options?

My response:

The only person you should be taking with you to the deposition is an attorney - - your cousin is useless to you, especially since she's a witness. Without an attorney, you're going to get blasted right out of the water because you don't know what you're doing.

Unless you file a Motion to Quash against the Notice of Taking Deposition, and you win that motion, then you SHALL appear come hell or high water.
