May I provide a deposition taken for a settled civil action to be used as information gathered for the filing of a state agency complaint?

This is a complaint being filed with the California State Contractor Licensing board regarding unlicensed contractors in which the individual whose deposition was taken for the civil case admitted working on many construction jobs unlicensed. The intention is to provide the state with adequate evidence supporting proof of the work done by an unlicensed contractor.

Maybe. But, evidence has more of a list of things rather than a single one as the issue. Without knowing the complaint or the testimony (and the people involved) no one can guess.

The deposition testimony is testimony under oath and sounds as if it is relevant to the proceeding in which you wish you use it. Generally it would seem to be proper to submit it in an administrative procedure.
