What is the name of your state (only U.S. law)? Nevada. I was contacted by detective regarding an incident on a verbal argument with girlfriend. It got heated and she almost ran me over....With emotions running high I keyed her passenger door maybe a foot in length.. Yes it was stupid..I tried many times to contact her to settle damage to no avail. Then i get call from detective about 3 months after asking what happened. I said little..but did not deny it..Is she charging me or her insurance had to file report? With her willing obviously..

If the detective did not say who the complaining party is, then you may never know unless the matter goes to court. Ultimately, it won't matter. If the state pursues criminal charges against you, then it will be the state of Nevada prosecuting you, not your (ex??) girlfriend or the insurance company.

It is likely that your girlfriend has reported the car damage to both her insurance company and to the police.

In Nevada, malicious mischief (destruction or damage of property) is criminally charged based on the value of the damage. The insurer will assess the damage and the police can charge you with destruction of property according to the amount assessed. You can face a civil action and a criminal action over the keying of your girlfriend's vehicle.

Here is a link to the law (see NRS 206.310): http://www.leg.state.nv.us/NRS/NRS-206.html

You would be smart to consult with an attorney in your area. If the police visit you again, you should exercise your right to remain silent and you should refer all police questions to this attorney.
