The father doesn' have to pay CS until it's ordered by a judge. The father has the right to petition the children have his last name, again, decided by a judge but it has no relation to CS.

No, the father CANNOT refuse to pay child support if the child doesn't have his last name. However the father has the right to refuse to pay child support until paternity is legally established and child support is ordered by the court.
The father also has the right, once paternity is legally established, to petition for the child's last name to be changed to his. He may or may not win that petition depending on the circumstances.
