Disabilities with Probation Violation

I've been on and off probation for 7 years I'm 25 now. I've been to jail multiple times and prison 2 times. My worst charge being a terrorist threat and a OFP enhanced to felony which I'm currently on probation for. In 2015 I had acquired a TBI which led to multiple mental problems such as memory loss, short term memory loss and I've been struggling ever since, I wasn't able to follow through with proper help because my doctor was 4 hours away. I also suffer from extreme anxiety and depression. It's hard for me to talk to people it's hard for me to keep appointments to get things done. I also suffer from substance abuse which has held me back from getting proper care. I have been sober for 5 months since I last got out of jail. I am required to do 20 hours a week of structured activity or go to community service 2.5 days a week. I live 10 miles out of town and have been struggling to meet this goal. My last hearing the judge added the condition that I report any missed appointments to my PO I babysit everyday for rent and I do online tutoring with children 20-35 hours a week and he will not count that as structured activity also I go to dose suboxen and that takes up 4.5 hours along with 3 different therapist/counselors I talk with. My PO was gone for 3 weeks and during that time I started missing physical therapy, it was never court ordered so I didn't think much of it, when he got back after the 3 weeks he called my PT and they released my information without an ROI(I've already reported them and asked my services be ended). He told me he was writing a violation, he hasn't been able to get ahold of my treatment counselor so he said it won't look good for me if he can't get ahold of them becausr he wants something good to add in so I made sure they did and they told him all my UAs have been clean and I've been doing everything right, that same day he finalized the probation violation and never mentioned how good I'm doing. Also I got my GED In the last year & I'm registered full time for college starting January which he didnt mention either. I have told him multiple times that I have no transportation and live 10 miles away from time but he Insist I make it to community service twice a week. I have bad anxiety and can't ever think of what to say to defend myself. He never tries to contact any of my workers. He knows I have a disability but without me being able to get to appointments I have no current proof and I really struggle to help myself stay on track why I have so many workers He wants me to sit 30 days for the violation and an additional 10 for each day I missed physical therapy. I have court december 23rd over zoom. This is the best I've ever done in my life I'm so happy to be sober and going to school soon. I have big disabilities and I don't think I deserve to go to jail for missing appointments. Please somebody help me or direct me to help. I live in Minnesota in a small town called clearwater county. Over the years my TBI along with drugs and mental problems have destroyed me as a person it's taken a long time to come this far and I'm finally starting to heal. I didn't break any law and Ive been doing my best I really don't wanna go back to jail I've sat over 3 years of time I'm finally ready to have a life it's gonna take a lot of work but I'm ready for the help. Aside from that how do I get the courts to treat me fairly and look more Into my health conditions who can I reach out to. I've had a piece of shit life and I've done wrong but I did my time and I'm just trying to get better and it's so hard finding myself and learning how to talk to people again please somebody help me figure this out

First, you should be applauded for remaining sober for 5 months and for completing your GED. Those are important accomplishments.

Because of Covid-19, there are more opportunities online than ever before to find “structured activities.” I think that tutoring children should be an acceptable activity if you are tutoring on a regular basis and have proof of these tutoring sessions to submit to the court.

Clearwater County is small so I am not surprised you are finding your options limited. You could try to find some direction from Clearwater County department of human services. Try: https://www.co.clearwater.mn.us/index.asp?Type=B_LIST&SEC= Use the Menu and click on “Departments, Human Services.”

Is there any transportation available to you (car, bus)? Do you have a friend who can help you get to appointments?
