What is the name of your state?WV
I have a general (under honorable conditions) discharge and I want to upgrade to honorable. Do I have a better shot for an upgrade if I seek legal help, which I really can't afford? What type of documents should I provide to the review board?

The reason for the general charge upgrade, I was not considered for a few positions because of the discharge. The question about the discharge was bought up in the interviews. And each time I was told that I could have taken care of that 6 months after I got out.

I think badapple was asking why you think that you deserve a discharge upgrade- not why you want an upgrade..

I think who evers telling you that you can "take care" of it after six months, has the wrong idea about it. from what i understand, its not that easy. you have to have proof that you were given the wrong discharge.. Then you have to prove to a board that you should have gotten an honorable....

I dont see why you wouldnt be considered for positions because of this discharge... You can work for the federal goverment still. idont see why some sorry private employer would discriminate///

I too, was discharged under "General Discharge - Under Honorable Conditions", and I was told by a JAG officer (my lawyer at the time) that it is an almost automatic upgrade to "Honorable" if you wait six months. He said most people don't get the upgrade simply because they do not apply. It's been three years since my discharge, and I am only now seeking to get it upgraded. Besides filling out the form (or the online version), what more do I really need? If it's true that it's almost "automatic", what other supporting documents would I need?

the JAG officer at the time misadvised you. These are NOT automatic and are routinely denied unless you can show some legal error in the issuance of the discharge to begin with.

My brother-in-law was given a general discharge under honorable conditions, he was given that discharge because he went AWOL after 6 months in the Army in 1973, 6 months after he was discharged his discharge was up graded; He was discharged after the AWOL with only 6 months active duty. In 6 months his discharge was upgraded and he was going to college on the GI bill, he now has full Veterans benefits. You can get the form for requesting the up-grade at any veterans service officers,the veterans service officer can at your request file the petition for you.All counties have veteran service officers, in your county of residence. If you have to give a reason as to why you want or deserve your discharge upgraded. Make the declaration, that all Viet Nam era draftees that fled the country to avoid the draft, were pardoned for a felony crime against US law, and you believe that your offence was not of that magnitude, and you deserve the right of an up-graded discharge. By the way you don't need any legal help to do this, the Veterans service officer is bound by duty to assist you, and do it for you if necessary.

Has anyone else ever heard of this happening? It sounds to good to be true wich means it probably is

This hasnt happend to any of my soldiers or returnee's. Whats your Time in Service and any certifications or designators?

Depending on this you can request a review of your discharge after 180 days, it is NOT automatic.
