What is the name of your state? Washington.

Ok, I was working for walmart for about year n half. In dec 2004, I got pregnate I ended up lossing the baby. It required me to have surgery. So I had to take medical leave of absents. When I returned, my district manager took my position away from me because of my absents. and guess what days she counted against me. yes the days i was in the hospital lossing me baby.. Is this considered discrimination?

Not necessarily. Just because you were demoted doesn't make it discrimination. It's only discrimination if you were demoted BECAUSE OF your membership in a protected group.

At the time you had the miscarriage, how long had you been working for them?

Neither the facts of her custody situation or anything else that is going on in her life, has any bearing whatsoever on whether or not her employer acted legally.

There is no evidence of discrimination in her post. However, without additional information, none of which has anything to do with the information in her other posts, I can't tell if any other laws were violated.

If you want to analyze people's life issues that's up to you. My purpose in being here is to answer their questions about employment law.

The title caught my attention... even if that was discrimination, wouldn't the time limit for filing a complaint be passed?

CBG,
I know why you asked the question and that there is no evidence of discrimination from the post. From her posts it is obvious that other information required to advise was not going to be forthcomming.

I agree that there is no evidence of discrimination and if she doesn't want to answer my question she doesn't have to; she just won't get any more answer from me. But I still say that the information in her other posts has no bearing on the action of her employer.
