What is the name of your state (only U.S. law)? California

1. I was not given my full job title & hours back upon my return from Maternity & FMLA. I was getting close to 40 hours a week as a server/ SA. I was a host/ SA right before leaving, but when i returned i was only a server working 20+ hrs.
According to FMLA I should have gotten my title or equivalent pay upon my return. This did not happen and I spoke to management. Even went higher up and threatened to look into my legal rights and council.

2. I was then written up, harrassed at work regularly. I was a model employee and suddenly I was being nit picked and written up for everything!

3. I was let go in September for "cash handling" I turned in a lunch $2 coupon in place of a $4 dinner one. I was suspended the next day and then fired the following day after that. On my firing date the manager paying me out over paid me by $5. Once again I did the right thing and told them and handed back the overage.

4. Since firing in Sept. I have been trying to decide what to do. I was thinking move on and let go, but now I have been served to go to appeals court over my unemployment.

5. I have also recently found out that the General manager is still obsessed with me. I feel its harrassment. She has people viewing my facebook now. She asks my long time friend that still works there on a regular bsis how i am, has she seen me, do i have a job? Why?

6. I came in finally to have a drink while waiting for my long time friend to get off work. The GM was not there. i had my drink and left with my friend. Now the GM is grilling all the staff about who I spoke to while i was there, what did i say, etc. Really

Finally on a statement written by the manager on the shift of the "cash handling" issue submitted to the court for the appeal hearing it states, "I realized that Gina used the 2nd coupon to profit $4 because it was used on a cash table." Can this be construed as slander? She is saying I did it intentionally, not that she thinks or suspects. What is the name of your state (only U.S. law)?

You can file a complaint with the US DOL for FMLA violation. You can actually file with the state as well (will be faster) since CA has a state version of FMLA.
