Dismissing a Warrant in another Sate!

I was wondering if anyone could possibly give me an answer. A Friend of mine who lived in Iowa and moved to Texas had a Warrant and was arrested and released on ROR. He moved to Texas and the Police there arrested him and told him that they have to hold him until Iowa comes to pick him up. After isx Days they let him go and told him that Iowa did not want to pick him up and they would drop the Charges against him.
About a month ago an Officer pulled him over because his License Plate on his Car showed a Warrant attached to the Plates. That Officer from Texas called IOwa and confirmed that there no extredition out for him. The Officer also explained to him that the Warrant was still attached to the PLates and he should get him Texas PLates and that would eliminate all the Problems. The Officer even printed out a Document for him stating that he personally called to the Iowa Couts and confirmed that the Warrant will be removed. But as of this Day Iowa has not done so. Now my question is: Since he got the Printed Satement from the Police Officer confirming that the Charges had been dropped and that the Attachment on the Plates would be removed and thats not correct. Can he go back to Iowa and not have to worry about him being re-arrested because of the Officers written Satement???? He really would like to get back to Iowa but he is afraid that they will re-arrest him even do they told Texas that the Warrant is dropped against him. What can he do?? Is he safe to go back to Iowa???

When a warrant is issued and entered into NCIC it is possible to designate that it be for the issuing state, the issuing plus surrounding states, or for all states. The reason is that a state may be willing to pay alot money to extradite someone across the country for a major crime but may only be willing to extradite a short distance for a minor one.

If the warrant is still "attached" to his Iowa plates then to me that sounds like the warrant is active in Iowa and they just changed it from all states to Iowa only, or maybe also for surrounding states. The only way to know for sure is for him to call the Warrant Division of the Sheriff's Office's in the county where his alleged crime occurred. They will usually tell you if you have a warrant out.

The warrant would not be vacated just because he got caught in another state and was not extradited. The warrant is probably still active and he'll get hassled anytime he gets stopped anywhere - if a warrant check is done.

If the NCIC entry was changed to specify no out-of-state extradition then he certainly faces arrest any time he is in Iowa. And he could possibly be detained anywhere else pending confirmation of the conditions of the warrant.

Your "friend" needs to find out what he must to do in order to satisfy the warrant and get it vacated. That will likely involved a trip back to Iowa.

Your friend should hire a lawyer and get his legal problems sorted out.

Lastly, if your friend is a resident of Texas, and no longer resides in Iowa, he need to transfer title and registration (plates) of his motor vehicle(s) to Texas. Not doing so is a violation.

How true. But when we run a registration check the registrant is automatically checked for warrants without running a separate check.

Getting Texas plates will eliminate THAT problem but will not eliminate ALL problems. Of course, the bottom line is that this "friend" has a warrant which will be there regardless of any vehicle that he operates.
