What is the name of your state (only U.S. law)? Georgia

I wanted to get divorced before the end of this year so we could file taxes separately. Now it doesn't look like that will happen. If my divorce is final in January, can we file taxes separately for 2010 ?

If you are still married on December 31, then you will still be married for tax purposes. However, you can file separately. You are not required to file a joint return.
