Hello:

I have a question that just hit my head yesterday. Early last week I had my court appearance for the DUI. Next week I will have the DMV Administration Hearing. According to my lawyer, I'm looking at a 45 day suspension of my license possibly (this I already know). My question is... I'll be driving myself (and alone) to the DMV Administration Hearing, for friends and family will be working that day (as I should be myself). If in fact I receive the 45 day suspension, will I be allowed to drive myself home after the Hearing? Like I said, I just thought about this, and certainly don't want to be stranded over an hour away from home. Does anyone out there know how this works? If so, please post here and let me (and others) know. It would be greatly appreciated!

You may want to take the bus. Or realize it will take a day or two for a suspension to show up on your driving record.

According to my probation officer, a fellow just last week down here was denied the license for the very reason that the DMV staff watched him drive to the hearing through the window.

Take a bus, take a taxi, ride your bike..... but don't drive there.

Maybe. Pull out the paperwork you received from the officer at the time of arrest.

Is there a receipt for your license that allows you to drive until the Admin hearing?

If so, check the dates very carefully. If the hearing date is within the time period specified, you should be able to drive until the end of the day (11:59 PM) the period runs out. That would allow you to drive home from the Admin hearing.

If your hearing is scheduled outside the time period specified, it may... MAY... be grounds for dismissal of the suspension. No guarantees, but even a slim chance is better than none.

Also, while you're at the DMV, ask about obtaining an occupational or restricted driver's license.

Thanks.... OMG!! Another dilemma!

First and foremost, thanks to each of you who have responded!

After reading the last post... I have pulled out the Police form and realized that my 46th day was actually April 21st!!!! OMG!!! Have I been driving illegally since then? I had no clue whatsoever!!!!

Thing is, my INITIAL court date for both (including the Admin Hearing) was set back in March (25th to be exact). BUT, since my lawyer was unable to attend either, he put in a postponement which was granted. Thing is, I just had the postponed court date last week and the postponed admin hearing is next week, which is totally outside the 45 days given on the Police form. That said, have I indeed been driving on a suspended license for the past 20 odd days, or do they adjust the 45 days once a postponement is granted? And if they do adjust the days, where in fact do I begin to count days up to 45?

I know this sounds confusing, and for that I'm sorry... I can honestly say I'm thoroughly confused right now (and will be calling my lawyer in the morning as well)... However, any insight on that matter will be greatly appreciated once again!

Thanks thus far for your input, it has certainly opened my eyes to another issue I had no clue existed 'til now.

Please advise...

The postponement is gonna screw this up. Are you absolutely certain that the Admin hearing was postponed, and it wasn't just the court date?

If it was just the court date, not both, and the Admin hearing was missed, you're toast.

Do you have documentation from DMV advising you of the new Admin hearing date? There may be something in there extending your driving privileges until the new hearing date. If not, you're pretty screwed.

Do not drive to the hearing, or afterwards, unless you can get an occupational DL while you're there.

That's a good question. You'll need to read the paperwork you got from DMV advising of the new hearing. If you didn't get anything, you need to call them and ask, and/or call your lawyer.

That's why you absolutely have to read everything given to you, and reread it until you understand it. That paperwork is your official notification of what's going on. If you fail to read it, DMV assumes you've been notified, and are deliberately failing to comply.

You need to get unconfused. Get off this website and start doing some major research on the DMV site.

Okay, I got off this website for a few and went through all my papers, then just went to my car and pulled the papers I put there sometime ago. I guess due to the time passed and being completely overwhelmed by all of this, I forgot that I did indeed receive a "driving privilege extension" via the DMV back in late February, and had placed it in my glove compartment. Thereby, I HAVE NOT been driving on a suspended license. The priviledge is good up to my Admin Hearing which again is next week.

I did post a question about the SR22 thing though. Is that something I have to worry about? I have checked the DMV site along with others, and it appears that anyone with a DUI is required to fill out such a form. In doing so, does this effect insurance.

ARG!!! I'm surely getting on somebody's nerves here for all these posts and questions... I have been told that I ask too many questions. LOL!!!

Being a police officer, I'm pretty well versed in the DL and court hearing stuff. I don't concern myself much with SR-22 issues.

Here's the extent of my SR-22 knowledge:

If the State says every DUI gets it, you can't drive without it. Period. Not just your own car, ANY car.

If it lapses due to nonpayment, your license goes away.

It's outrageously expensive. :eek:

The only good news is, it doesn't last forever.

Finally....

Hey Guys:

Just an update... I took your advice and asked a family member to go with me to the Admin Hearing. I can't agree more with what was stated (and would certainly give the same advice to another if asked). Long story short, FINALLY it's over (aside from the supervised probation visits for 6 months), the Judge at the Admin Hearing, allowed me to have my license back with restrictions for both work and school for the next 45 days. I could have cried, for I was so worried that it wouldn't be allowed since I live fairly close to both. It has certainly taken a load off my mind. This entire experience has been a nightmare, and there have even been times where I thought it a dream (unfortunately it wasn't). I wouldn't put my worst enemy in such a predicament, and I for one will not put myself in such a situation again!

And not to sound cliche', "please don't drink and drive!"
