Do I have grounds to take legal action?

hello my question is for the state of Iowa. my current manager at my job has told employees that he fired me. this however is not the case, i am planning on notifying the company that until action against him is taken i will not return to work. i also plan on asking for written notice of the action being taken. if they do not provide me with written confirmation of taking action and what the actions will be i have told them i will seek legal advice on how to proceed. if they do not notify me within thirty days will i have a case against them?

Why do you think the company is obligated to do anything you demand? You are owed nothing but compensation for the hours you've worked. That's it.

The likely result here is that they'll hold you to the 30 days, then when you try to get UI they'll simply tell the truth .. you quit.

Really, at first I was assuming that you have already left the job, that you resigned, gave notice, quit, whatever, and that for some reason you think that is a more desirable reason to have left the job than being terminated. And that your former manager told someone they had fired you after you were already gone.

But then you say you are going to notify someone that until action is taken against him, "I will not return to work" so what on earth could you mean by most of this post? Is it that you are still employed, that you were away from work, and the supervisor told a co worker that he had fired you? And you think you have rights to keep this from happening and that it's a good idea to demand some sort of satisfaction from the company or punishment for your supervisor, or you're leaving...um, frankly I think you are seriously misinformed about your rights in this "at will" state. If you are going to seek legal advice on how to proceed, don't put any money down with an attorney before you have a consultation.

It is perfectly legal for managers to tell employees that they have fired someone, when in fact they haven't done so.

In addition, employers are not legally obliged to take action against managers who do legal things such as tell their employees they have fired someone, when they in fact haven't done so.

Given this, no, you do not (nor will you have) a legal cause of action against your employer.

Wow. Who do you think you are that you are able to demand such things from your employer (oops. Make that your ex-employer. If you haven't been fired, you surely will be very soon)?

I'll be honest. If I was the employer here, I'd simply wait out the 30 days and assume the OP quit (for no good cause).

i am planning on notifying the company that until action against him is taken i will not return to work. Good way of making it look like he's right, isn't it? More fool you if you actually do this.

They not only have no legal obligation to provide you with either written or verbal notice of any action taken, they have no legal obligation to take any action.

Let us know when the lawyer providing the legal advice stops laughing. You are playing into the manager's hands and shooting yourself in the foot.

if they do not notify me within thirty days will i have a case against them? Not in the slightest. The only legal action you'll have grounds to take is to apply for unemployment, and since the employer will have a fairly easy time proving that you quit, getting UI benefits is very much a long shot.

First of all I want to thank everyone for replying, i simply asked the question to try and obtain any information I could about my situation and to begin to learn about my rights. most of the information was quite helpful and again for that I am thankful. I guess my main question that I unsuccessfully tried to get across was do I have the right to demand action be taken against my manager for making false statements about my employment, this question has been answered and I now ask that anyone posting rude comments with their opinion of me and my situation discontinue to do so.
