I have two daughters. They are US citizens because they were both born in the US. One is 4 years old. The other is only 1 month old. I have H1-B visa now, but I will lose my job soon because the company is in
big trouble. Mean while it's not possible for me to find another job. My questions are: 1. Do I have to leave US with my two daughters once my H1-B visa expires? Is it legal for me to stay in the US taking care my
daughters without a valid visa? 3. If we go back to China, what kind of visa can I apply in order to escort them reentering US in the future because I want them to get after-elementary school education in the US?
If my visa application is denied, does this mean they can only reenter US when they are 18 years old? Thanks a lot for your time. Your help is highly appreciated

If your wife from china too ?.. What visa is she on ?

No you can not stay in the US without a visa. For a start you will not be able to work.

You would be wise to speak with an immigration attorney as I do not see how you will manage to stay in the US without having a visa and therefore not able to work. Once you both leave the US, you would not be able to just come back and put your childing into school, again, you would not have a work related visa. Good Luck.
