My husband quit working 3 years ago except for jobs where he receives cash (he's able bodied). I don't know how much he makes. I have a middle income stable job and have been supporting the household for these years (he lives here but doesn't help much with duties). He refuses to move out. IF I file for legal separation or divorce, will I be required to pay him alimony? Is there any way the kids and I can live in the house (I can't afford 2 housing payments). We live in Washington State. Two kids, 6 and 8.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

1. Most state divorce courts allow the mother and young kids to stay in the family home: cuts down on disruption to children.

2. As for alimony, he will really have to show why he cannot work. Soooooo.., you hire a divorce attorney and get the process started.
