I live in Ohio, and got a girlfriend on H1B Visa. However, she is about to graduate and cannot find a job. I am just a student and currently don't have a job and was wondering if there is a minimum income requirement for her to become U.S. citizen and if I marry her as a student, would I be able to atleast extend her stay? If income is required, will U.S. actually allow her to stay longer so she can gain U.S. citizen?

Thanks :)

This is the worst possible idea. DO NOT sponsor this girl. DO NOT even think about marrying her just so she can stay.

Wait.

How is she on an H1B visa if she has no job?

You need to be able to support her up to 125% of the poverty level, anytime she is either unable or unwilling to work and earn income to that level. You will be obligated to support her even if you get divorced, even if she cheats on you, even if you discover the relationship was all a ploy to get your sponsorship and she never actually loved you. Even if you are only married for a short time and would not normally be ordered to pay spousal support. This obligation will stand until she works for about 10 years, becomes a citizen, or permanently leaves the country. This means you could be supporting her FOR LIFE, even if your relationship doesn't work out. Can you afford to do this as well as supporting yourself? If you can't, you shouldn't even be considering it. And if you have no income at all, I don't think you would even be allowed to sponsor her, because you'd need to show the government that you have the ability to support her so that she will never become a welfare recipient.

what does this mean here, "obliged to support"?

who sues who, and whats the consequence? like child support?

sounds like a bunch of bs scary bedtime stories.

Before you start getting reported, allow me to "hedumacate" you a little.

(Then once you're banned, you'll have something to read while you're trying to figure out a new screen-name)

The I-864 is a contract between the sponsor and the US Government.

It essentially promises that the sponsor will provide enough support to the sponsored immigrant that the immigrant will not become a "public charge". Divorce does not negate this obligation.

Get your best Googling fingers out, and search.

so you have no idea, but that doesnt stop your fingers from twaddling.

ban away. this is why lawyers are worthless, and so is this site. i wont be coming back. except for carl the norcal cop, whose many posts throughout the interwebs have earned him a fine reputation.

@ OP: i think if you can show 3 times the required income in property (money etc) that enough to sponsor.

I've forgotten more about I-864 issues than you'll ever learn.

And you'd be wrong.

Or, you can have a relative or friend sponsor her just as I did with my spouse who is not from the US and I had no income at all. But it would have to be someone who really loves you and trusts you as they will be responsible for her if she ever needs to go on aid. I know a lot about this subject. I read expats boards, and lots have done that.

Yes, lots of done that and for most of them it has worked out fine. Unfortunately for some of them it has been a real disaster.

The OP also needs to be certain that he truly understand the person's current immigration status. Its true that an HB1 visa is not a visa for someone going to school in the US. Although, if the person is a dependent of someone holding an HB1 visa they could have an H4 visa which would allow them to attend college.
