What is the name of your state (only U.S. law)? New Jersey I am married and my husband worked under the table. I got a small job late in december and my w-2 says i made $266.00. Do I have to file federal and or state taxes? also wont I get caught if asked about my husbands income? I had no idea this was being done unfortuantely until i married him. yes i know that sounds stupid but its the truth and i dont want to go to jail for his illegal doings. he is also going to be filing for social security in may when he turns 62 and isnt he going to be asked to provide some sort of proof of income for the past? i know he filed taxes i think for 2010 again not sure but for sure in 2009 . i am so nervous and scared as i am now going to be working legimately as i always have and dont know what to do for next year when i have to file as well. he says to say he is retired but then again where is his money coming from if so. so stupid . he would be getting a pension then if he worked legimately which he hasnt . i think some years he filed and some he didnt? im not sure at all about this stuff and just dont want to get punished for his doings

You do understand that the "under the table" income is required to be reported if it amounts to more than $400 in a year?

Social Security isn't quite directly tied to filing taxes but it does require that you have had a history of income where you paid social security tax (either as a W-2 employee, or you paid the Self Employment tax).

You had better have a strong talk with hubby about obeying the law. It will get you both in potential trouble.
