My mother and her husband are going to court with charges against my stepfather for a felony ...wanton endangerment.....they have no case against him with out the victim who will not testify and now his lawyer is telling him that they are not goin to use the victim that they are goin to use his wife instead......my question is does she hvae to testify or can she refuse........the vicitim was a intoxicated 17 year old son who has since said he made a big mistake.
