Here's an update for you on what's happening;
I have found an am retaining an attorney in the county I want/need to change the venue to. I will be having my first official appointment with him next week.

My daughter is so anxious about all this! She can't wait to go talk to the new people, she hasn't said anything to her father about what's going to happen.

I received a copy of everything in my file from the courthouse last week, let the DA know that my X's wife has been giving out information which she obtained from work. Though I didn't make an official complaint, I made the DA aware of the situation.

I also found out that in Dec 2000 the X was awarded sole physical/ legal custody of the oldest child, though there is no set amount for child support (yet, he collects from me-not complaining) I've gotten some information from his case for fuel for my case (hopefully it will be accepted in court).

ANYWAYS... On to the question;

I'm trying to save myself money, and instead of paying my new attorney 200.00 an hour to drive to the presiding courthouse to get the papers, I'd rather pick them up my self, or print them out....

Does anyone know of a website that I can get court papers from? I need to get Change of Venue papers, and really don't want to go back to the court house that has Jurisdiction over the case, because everyitme I go, the clerk's inform my ex's relative who works in another office in that courthouse.

right now, I'm not sure if my ex knows if I've been there or not. If he does, he's not saying anything. I know his relative can't keep their mouth shut....

P.S. I finally received my mini tape recorder with mic. AND great news, My portable phone recording mic works on it as well!! I'm so ready for any smart @$$ remark from the Ex to submit! I don't care if CALI is a two-party state (my Atty will be the only one listening to it - and maybe the mediator)

My response:

I hate to tell ya, Doll, but there is no such thing as a "Form" for changing Venue. It's a full blown Notice of Motion and Motion for Change of Venue, with Points and Authorities, Argument in Favor, and Declaration. And then, it's going to require an appearance by your attorney in Court - - if there's an Opposition filed.

Sorry, but it doesn't look like you're going to be saving any money - - at least on this procedure.

I don't think the X will oppose, but then he is "Stupid" (hence the nick-name). Do you think I should get a complete copy of my daughters school records?

I'm thinking this will show alot more discrepencies in his 'stories' as far as addresses, and other information (depending what's in there).

What do you think? Cover my bases or it doesn't really matter?

Sure, get all the records. However, for them to be accepted by the courts, your attorney is going to need to Subpoena those records from the school. Evidence needs to follow a strict "chain" of possession. Therefore, it would be a waste for you to get the records (except just to look at them), because you're only going to have to Subpoena them anyway.
