Again, divorce final in May. Ex moved out about a year ago. In the divorce agreement he pays the first mtg and I pay the second until the house is sold. He claims he can enter the house whenever he wants without my permission. All I ask is that he call first, and I never tell him no. However he snoops and takes things out of the house and I don't trust him.

What are my rights? Our decree erroneously states that we do not own any properties jointly, but I am not complaining as I live in the house.

So, what EXACTLY, if anything, does the divorce decree say as to his access to the property??

You can certainly try to change the locks etc., but if the order is silent on the issue (bad attorney!!),..... he can demand access as he is still an owner. If silent, you will need to get a court order as to his access.

Decree does not address at all. It does say that we do not own any property together and while that is wrong, I wonder if that would benefit me at all? Judge signed off on a settlement that I never signed or agreed to.

Nope. All he has to show is his drivers license or other proof that he lives there. Hell, he could carry a copy of the title/deed in his pocket for all we know.

Not true. Your attorney, acting as your 'agent', signed and or presented to the court.

He doesn't live here

He lives with his fiance and he doesn't have anything showing that this is his address. He is only on the loan.
