In California, if you are considering taking action against doctor(s), does it hurt your ability to get anything from them if you pay the bill for the event where the error occurred? Also, is it advisable to let them know they made the error (in a case where they can't help any more?) What is the statute of limitations. We don't know the final outcome yet.

My response:

Paying the bill, and allegations of medical malpractice, are two distinct issues. You can pay the bill without waiving any rights to a potential lawsuit.

The medical malpractice Statute of Limitations can be complicated, as are the Statutes for malpractice in general - - especially the MICRA Statutes.

Please obtain advice from a local attorney who specializes in Medical Malpractice concerning your rights. Most attorneys will afford you a free initial consultation.
