Does Title IX apply to AAU?

Does Title IX apply to AAU organizations? I'm coach of a local boys basketball team, but I have two females on the team. The IEAAU does not accept "mixed gender" teams in their tournaments. I feel this is discrimination. The IEAAU uses public school facilities in the Yakima School District to run these tourneys and I believe it's breaking federal law by not allowing our girls to play with their team. The IEAAU answer to all of this is that they offer an all girls tourney also. Is this still discrimination? Help Please?

It seems as though Title IX is satisfied if there is equal opportunity to play. If a school has a men's and a women's team in farkeling, it is not discriminatory if they don't allow women to play on the men's team. (Just so you see the point, the reverse is true also.)

The use of public school facilities may make it possible that Title IX is applicable, but I don't want to do the research needed to find out.

That's because on the face of it, the organization *does* provide equal opportunity by having a girl's tournament and if Title IX applies, the requirements seem satisfied.

Besides, how much do you want to spend to make the case?

Right now I am in the exploratory stage to see if we even have a case or any legal grounding, but I'm willing to go all the way for this. We teach our kids they can do and be anything they strive to be... I don't want to just pay lip service. Thanks for your insight, I really appreciate the reply.

The IEAAU has a girls program. Nothing in title IX (even if it were to apply) mandates that co-ed teams must be allowed, just that the programs have to substantially proponent to the sex distribution of the enrollment.

Proportional is fairly fact specific and through case law. Here the school would be the covered party and they would be required to enforce the statute. Since those involved may or may not be attendees at the school, even if Title IX is applicable, what would the standard be?

By the way, I am a strong proponent of Title IX. I just don't see the hurt here. By the way, is the team about 12 years old or so?
