Doesn't sound right

My husbands father is mentally ill. He cannot think for himself. Last year my husband went down there to try to get him help to no avail. He called his sister and told her that her father was ill and he needed help to try to get him to the dr. she didn't want to have anything to do with it. His father finally decided to go to the dr. and he was on medication and was doing well. (we believe the reason that he finally went and got help is because his daughter told him she was going to get guardianship over him) Basically a threat. We had been trying get a hold of him for sometime and he finally called us back yesterday.

Now my husbands sister has taken over all of his finances etc and we think she may have a power of attorney as well. She has sold his car and taken his other vehicle to Oregan to where she lives. They have put him in what they are calling a nursing home but we are not sure. Can she do this even without consulting my husband? I mean it is his father as well. Doesn't he have a right to know that she has gone and done this without consulting him?

However, something is afoot. You have not given us enough info, but son needs to go tend to pa asap and clear this all up.

Son needs a lawyer to help him. If pa signed stuff and pa's not right in the head, then there's no way around hiring a lawyer cause sis is thieving and you need to stop her.

I'm not sure of what other info you would need. I do know that she had gotten access to his safety deposit box and has removed the contents. His will was in the safty deposit box which states that when his father dies my husband is supposed to get his house.

We think something is up. either the house is in my husbands name or because the will states that my husband is to get the house why wouldnt they sell the house as well? Why just sell his BMW? If we do get an attorney would it have to be in the city that he lives in? He is in El Paso we are in San Antonio? Would we be able to contest the POA? Can they change his will even though he is not menatlly there? Thanks for anymore advice.

I forgot to mention that she put him in the phycho ward and had him evaluated there. Then the Dr. told her that she needed to have someone take care of him. Is it possible for the Dr. to suggest that she get a POA? I thought you had to have the court decide?

A: Anything is possible.

A: Courts have nothing to do with POAs (unless there is a lawsuit to declare one invalid).
