What is the name of your state?TX
My compnay has locations is various states, in one facility the people are classified as exempt, in another facility in a a different state they are hourly? Is this ok? They perform the same functions, just for different facilites?

It's okay as long as the position actually qualifies as exempt.

While most states follow the Federal regs for exempt/non-exempt status, some states have differing requirements. The difference may be based on state law. If so, it's perfectly legitimate.
