I live in De. My W and I have been separated for a year, neither of us have filed yet. i went to her house the other night to talk to her. she wasn`t home so i waited inside, since the door was unlocked. When she came home we got into an argument. I held her arms to try to talk to her and her friend tried to intervine by hitting me, so i pushed her away. She then jumped into me and started hitting me even more. i pushed her away again. My wife eventaully had to pull her away. During the first push the woman fell backwards on the floor. While I was leaving they called 911. The next morning the police called to say i was charged with assualt, offensive touching, tresspassing and criminal mischief, since a candle was broken by me. How can i be charged with tresspassing when she never told me i couldn`t be at her house? We`ve always came to each others houses. Can i still be found guilty of assault, for a push while i was being struck by someone? I did hold her arms and i did break the candle so i guess i`m guilty of those two, but what about the other two?

NO TOUCHING

I have no idea about domestic violence laws, but i know you have no right to HOLD anyone to make them LISTEN to you. If she dosen't want to talk leave her alone. You will have plenty of time in court to talk. Now is the time to find a hobby or go to church! Keep your hands to yourself. I know this must be a difficult time for you, but if you find that you're not in control, talk to a therapist or counselor.
