What is the name of your state (only U.S. law)? California

Hi,

I am currently on F-1 Visa, and will be joining a software gaint starting August 2012. I have filed for my OPT.
Meanwhile, company has also filed for my H1B using consular notification.

I am planning to travel to India for a month starting 2nd week of June. Can I successfully travel to India in this circumstances ?

And also how does H1B stamping in India work as I have been filed for H1B with consular notification. ?

Any advice/ suggestions are welcomed..

Thank you in advance,

Sagar

If your petition is for consular notification then there is no issue with traveling. Once your H-1B visa petition is approved, your employer or attorney will send you the original approval notice and copy of the petition and you will make an appointment with the US Embassy/Consulate that was indicated on the petition. Once your visa is issued, you will enter the US with that visa, thereby activating the petition. Please note that if the start date of the H-1B is October 1, 2012, you are probably going to be able to come into the US no earlier than about the 2nd or 3rd week of September.
