What is the name of your state (only U.S. law)? Michigan! Hello I was wondering if a Mortgage company demanded my mother signed away her dower rights at time of closing or they would not approve the loan, if that broke the law. Understand that my father applied for the mortgage my mother was put on it because they were married. MY father died and the bank is trying to take the house from my mother now. she is 82 years old.

Is the mortgage not being paid? That is the only reason that the bank would even care that your father had passed away. If the mortgage is not being paid, the house is collateral for the loan and the bank has every right to foreclose.

dower rights can be relinquished but even with dower rights intact, if a mortgage loan is not paid, the bank can foreclose. If you would care do describe the situation a bit more and specifically, why you believe a bank would not have a right to foreclose if dower rights were intact, it may help provide you with a better explanation of what is happening.
