I moved into an apt. recently and now have a downstairs neighbor who is harassing me. It's not blatant in that she's making stuff up. But she has been calling the police with noise complaints and the police are threatening me with a ticket of $350. The problem? My recliner.

It seems the noise of me closing it is startling her (she claims to have been in NY on 9/11 and gets startled easily now). Also, I stay up late at night and she's saying she can't sleep because of it.

Last night at midnight, I turned off my tv and was getting ready to go to bed when the police knocked on my door (again). Of course, there's no loud music or any other noise. The officer warned me that while he wasn't going to ticket me "this time" he would in the future.

My question: How can they ticket me for something they didn't witness?? She could lie and I would get a ticket, anyway?? That doesn't seem right.

The officer will cite you for a civil noise complaint and both you and the neighbor will have to appear in court to argue the case. I have a similar situation, and was able to use the neighbor's repeated complaints spanning years, about every upstairs neighbor who had ever lived in the upstairs unit over the years this tenant lived downstairs. It showed that she was hypersensitive and the judge told her she probably wasn't suited to a multi-story, shared-wall living environment. So no fine, but still a significant waste of my tenant's time.
