I was in A building where drugs were being sold.An undercover informant enterd the building to purchase with pre-recorded buy money.I opened the door so he can enter, at this time infomant handed the seller the buy money,in return the seller handed the informant three bags of cocain the informant state that we had a drug related conversation also two bag was found on window they state that we both had possion of this substance.My co-defendant pled guilty for a lesser charge because of my past history the D.A. also want to charge me for the sale & possion.At the time of my arrest nothing was found on my possition but $1.60

What it looks like is that you were part of a cocaine exchange, so you can be charged with possession and intent to sell. Good luck.

Thankyou for your input. I posted twice by mistake. "1st time" I open the door for informant to enter. He made the buy & assumed I was also selling cause I remained in the building.

Gee ... you open the door for the CI ... you remain in the area of the sales ... and you are surprised that you are being charged?

What's your defense argument going to be? That you were deaf, dumb and blind? Unless you can show that you reasonably had no idea that a drug sale was going on, then you stand a good chance of being convicted. The fact that you did not conduct the exchange has nothing to do with the sales charge - you were a participant.
