Worried friend

My friend got pulled over a few weeks ago and was given a DUI. When he got to the station to take a breath-alyzer, he blew just under the legal limit of point .08. He blew a .07. His license wasn't taken away but he had a court date. The officer said that 80 percent of the DUI's in the county (Linn-Benton, in Oregon) that aren't over the legal limit, are not prosecuted. So with that news, he felt good. But he went to the court hearing or whatever it was and they were going to put a case against him. He hasn't had any speeding tickets (I don't think) but said he has been ticketed twice for driving with no insurance. What should he do? They're offering diversification and that would take the DUI off his mark. But don't you have to blow an .08 for it to be a DUI? Any help would be really appreciated. Thanks.

READ ALL THE DUI stuff on freeadvice.com - it is under criminal law.
