I was on my way home from a night on the town. Yes I had been drinking, but at 4:00 AM I was driving home. I fell asleep & crashed into a stop sign. Both air bags opened & luckily I was not hurt. (just the car & sign) An off duty cop saw it & called it in. They made me perform roadside sobriety tests, on the driveway entrance where you would pull in or out of a shopping mall. Not on a flat surface like the road or sidewalk. This was slanted. Anyway, I was hit with the airbag & was dazed & confused, & upset about the car. The whole thing was video taped. He asked me to do the breathilizer & I asked to speak to my attorney first. I did not refuse. I was arrested for DUI. I retained a lawyer who has not communicated with me on the possible outcomes. My court date keeps getting postponed. My liscense is suspended & have a temporary work liscense. Everyone is telling me that I will get the max on probation & fines because I did not blow. Does anyone know? Do they have to prove I was drunk from the video? I passed most of the roadside tests. Those tests are hard to complete when tou are sober! Thanks. I am in Florida.

Your best bet is not to argue the point, but that you don't trust breathalizers. Did the offer a blood test by a real doctor? Say you wanted that for a correct result.
