I have been charcged with a dui in north carolina, I am 19 years old and blew a .04 in the patrol car and the same and hour later at the precinct. I am a little shaken about what happened and confused about what to do from here out if any one can offer any advice it would be meuch apreciated. Also is there a possibility of me using the defence that i blew the same after an hours time shows that it was on my breath but not in my system.

You blew a .04 after an hour or so? Guess what, under your state law, you are guilty when you blow .04 and above. So... no excuses.

Even though you are young, you are lucky you didn't kill anyone.

Take your punishment and don't drink and drive again.

LawRat is one hard a**ed dude! He is right though, good thing you didn't kill anyone, including yourself - lost a nephew (19) that way and it has almost destroyed our family. Good thing he only killed himself though.

Is this your first? If so, pled guilty with an explanation. Say you THINK you might have an alcohol problem and would like to get help -- Would be better if you signed up at a treatment center or Alcohol Annomous(?) first and took the paperwork with you to court (call your local MADD chapter and see if they can recommend classes). It would look like you are trying to help yourself - which you should anyway because you will learn that you are not just hurting yourself, but your family as well. I have 2 sons, 19 & 23 - didn't seem to learn anything from their cousin's death and we, the parents, are the ones who don't sleep nights because we are scared to death it will happen to them. Truth be told, if I knew then what I know now, I would have raised dogs - LOL
