DUI on prsciption drugs

What is the name of your state (only U.S. law)? N.C

I am prscibed xanax,and methadone (not methamphetamine),and I passed all road test. They pulled me over because i turned my head to look at a hors,and there were no oncoming cars. I crossed the line and they took me for blood work,they thought I was on heroin.

Is there any chance of beating the DUI(with a Lawyer) I am guilty of crossing th lin,and I know it is dangerous. Not that it matters but they did say thank you for being cooperative.

Xanax and methadone both come with printed warning labels that state you should not drive while taking the medication. If you wanted to admire the horse, you could have pulled over to the right shoulder and stopped your car.

Get a lawyer and follow his/her advice.

Got a lawyer(thanks) Remember lealea when driving never ever look to the right or left at all okay? Just stare straight like a goose with a broke neck,and you probabaly won't drive over the line a lil. Oh I am sure I am the only one who has ever done that too.
Im not to worrid just wantd to know if driving while on prescribed meds was illegal,and it has ben 12 hours in between,I work my arse off,and was tired also. I will beat it. Just taks $$$$$$$ $$$$$$$$ $$$$$$$$$

No need for the attitude. You may not operate a motor vehicle while under the influence of anything that may effect your impairment, especially when the substance specifically states that you should not operate a motor vehicle. I call a big "duh" on this one.

If you have a lawyer, why are you here?

Yes, it is. You can not operate a motor vehicle while impaired on ANY substance be it alcohol or drugs (even prescribed drugs).

Hey betcha didn't know that driving tired,your driving while impaird so,i am sure you have been a little buzzled yourself driving (DWI) (no sacasm intended)

DWI is driving while under the influence of an intoxicant. You have to introduce some intoxicating substance into your body to be DWI so being tired could never qualify. Driving while extremely tired could in some cases be a crime if you injured or killed somebody but the culpability is based on recklessness and/or negligence not intoxication.

I know this is an older thread but I wanted to say that it does not matter if the DUI is for heroin or prescribed drugs the outcome is still the same. The outcome being you were driving under the influence. When one takes these kinds of medications they have to be responsible and certainly not drive while on them. I take medications for pain and have a brand new car in the garage but I will not drive because I am taking them and I will wait until I have someone who can drive me legally. It is your responsibility to yourself and others to drive safely and though you may think your not impaired let me assure you that you are in fact impaired. There have been studies done on this and 90% of the people who take these kinds of meds think they are not impaired where the actual studies have proven otherwise. What if someone were in the other lane and you killed them then you would be looking at SERIOUS time and consequences consider yourself lucky and think about getting behind the wheel while on these meds because next time you could kill yourself or someone else.

Anyways it will cost 1500 bucks,and hopefully I will get a lesser charge. I no longer go to the prescribing Dr. I know DUI's are very dangerous,and I didn't have a clue I was in a DUI state of mind(It was like 10 hours since I had the meds,and drove).

Just curious...why did you stop seeing the prescribing Doc?
 
Man, taking benzodiazapines with methadone is not only one of the most intoxicating things you can do but you can die really easy in doing so, especially if you choose to drive. Dentists ( I know for sure, but not for other situations) use Valium ( similar to xanex), and morphine (opiate similar to methadone) for sedation when doing serious oral surgeries. When you mix benzos, and opiates it will heavily sedate you, and will also give you amnesia for the duration of your intoxication.

I say this from experience, I also take methadone for pain ( I was ran over by a car ). When I first started the methadone I almost died because I also have epilepsy and take clonazapam (Klonapin) which is another benzo very similar to xanex. The doctors prescribing the two had now idea I was taking something else. I now take methadone at 6am, and take dilatin at the same time to make sure I don't have seizures during the day, then I take the clonazapam at 10pm to make sure I don't seize while sleeping, and also help me to sleep as one of the symptoms of my epilepsy is severe insomnia.

The doctors make damn sure I'm sticking to this schedule, and not abusing my meds by calling me in randomly to do pill counts and frequently doing drug tests.

So I'm not saying that you should never mix the two, as there are instances where they are needed. But take great caution it's a very, very dangerous concoction. Before I knew this stuff one of the neighborhood kids died from heroin, and xanex, and we all just assumed that since he died with the needle hanging out of his arm that he just took way to much heroin but now I know it was probably the combo that did him in.

As far as being legal to charge you for dui, or dwi you bet it is. I was in court for a speeding violation and a lady was there for the exact same thing and argued what you are, and the Judge explained to her that if an officer deems you intoxicated, by one way or another whether it be by prescription meds, alcohol etc. he is perfectly within his rights to charge you with that offense. So, really if your paying 1500.00 for an Attorney look to double that by the time you pay fines if that charge sticks (in some case with first timers you can get it knocked down to reckless operations). Not to mention your insurance will be greatly effected if convicted if either but I find it very far fetched that a conviction won't result in this matter...

Well I quit going to see th dr for th same reasons that rocktopler posted,plus I am learning xanax with mdone DOES caus amnesia. Man does it ever,I am taking small bites at nite,and i mean tiny bites,like my councelour said to do.

OMG rock i'm sorry about your accident,but how long were or have you been on you combination of meds they had you on?

That's your fault. You HAVE to tell doctors about other prescriptions you are taking. Why the heck do you think pharmacists make so much money? Drug interactions can be FATAL! That's the only solace that med school students get while taking grad. school biochem (shivering as I type the word...). If YOU didn't explicitly tell the doctor what you were taking, you were asking for a horrible reaction. If you truly have such a serious condition, I would have to believe you would try to take such a simple measure to protect yourself from DYING.

Exscuse me mr reformed I never knew people got reformed from bing an addict.
Anyways I did tell the Dr I was on methadone,and he still gave 1 mg xanax in the mornings,and lexapro(which I told him I didnt really need(but they did help),and lyrica,and trazadone at night,and NOOOO those I left alone.

Just want to stick to my methadone now because it is so so hard to get off of.

Your bitching at me like you've never made a mistake. Now days the first thing I do when I see a new doctor is hand him a list of my meds. I still take both meds also just have to take them at different times a day. They tried to put me on a medication called kepra to control my seizures instead of benzos but they didn't work I had a major seizure 2 days after the switch so I have no choice, and it looks like I will be on the methadone much longer now too cause I just found out I need another serious surgery on Oct. 7th.

Anyway back to the point, Yea I'm well aware of that being my fault I'm not trying to sue anybody or anything I learned a valuable lesson since back then I knew very little about drugs, I was just sharing some info that may be pertinent to the OP...
