i was stopped in hillsborough county florida after hiting a pick-up truck from behind at an intersection. the officer at the scene smelled alcohol on my breath and administered a breathalizer test to me that showed my bac to be .16. there was no damage done to the pick-up truck and that driver left without incident or information exchanged between he and i. i was then and am now under a doctors care for testing positive for the hepatitus c virus. the drug prescribed to me by my doctor is rebetron 1000/pak-3 combination therapy pak containing: rebetrol (ribavirin,usp capsules) and intron a (interferon alfa-2b,recombinant injection). the medical information pamplet inside of each box of rebitron states under "adervse reactions" that therapy may cause serious psychological problems or cause psychological problems you are currently experiencing to become worse. some patients have had thoughts about suicide and have commited suicide. severe psychiatricadverse events,including depression,psychoses,aggressive behavior,hallucinations,violent behavior and rare instances of homicidal ideation have occured during use of rebetrol/intron use in patients with and without previous psychiatric disorders. i have pled not guilty to the dui and careless driving charges and dates for disposition of the careless driving charge and a trial by jury on the dui have been set. my questions are: 1. is my use of the affor mentioned drug a viable defense? 2. i am financially unable to afford the services of an attorney or an expert witness such as a doctor. may i present to the jury any literature contained within my perscription or what so ever i may find on the adverse possible effects of my perscription? 3. is this related to or in any way similar to an insanity defense? p.s. i have had two previous dui convictions,one in texas in 1985 and one in florida in 1996. my father died from an alcohol related illness and my grandfather on my dads side was an alcoholic. my mother had alcohol related problems resulting in three dui convictions in the 1980's. thank you!
