One of my dearest friends, was just caught and given her 3rd DWI. She is 23 and has not yet gone to court about it. I am wondering what the punishment usually is. I am certain that it is going to be harsh, but I am trying to prepare myself for any outcomes on this. I would really appreciate any advise that I can get on this.

Dear deidra23,

I can certainly empathize with you and what your friend is going through. My boyfriend is also going through the same thing. In fact, his trial is in two days.

I'm not sure what the laws are in your state, but in Virginia, your third offense is now considered a Class 6 Felony.

It has been told to me and I will now tell it to you - PLEASE advise your friend she will need to obtain an experienced DUI lawyer. Again, depending on where you are, plan on spending at least 3,000. We were fortunate enough to get a loan for our attorney.

Good Luck!

I do not know what state you are from, but in Kansas the mandantory sentence for a third d.u.i. is 90 days in jail.
This is not the minimum sentence either, it is MANDANTORY and it cannot be plea bargained.
You might want to check out the law in your state and see if there is a mandantory sentence.

GOOD LUCK!
