What is the name of your state? New jersey What can be done about someone calling in dyfs complaints that are done anonomously.... and the complaints have been found to be false by the police. This has happened 3 times and is there any way to stop it? I am clean and sober, have been for 2 years, but the complaints state that i am drunk with son in house, car ect......what recourse do i have... if any????

1. Tape record everything. As long as you are part of the conversation, you can tape record a conversation - I believe without even notifying the other party - however, this might be wise. You can buy a voice recorder almost anywhere: Target, Ebay, Best Buy

2. You might also consider recording what happens inside your home, as a precaution so that you have proof if the issue is ever presented in court.

3. Obtain all records from DYFS/Police and find out who is making the reports, then sue for libel, slander and/or defamation.

4. If you do drink, document everything - where, how much, witnesses, to show that it is not in front of the child, and does not affect your functioning around the child. Know where to get an alcohol test to prove to the Judge that you were sober at time of incident and protect yourself!

Why does the thread still exist? For the enrichment of others. My post contributes to that end. Please show the law/forum rule that posters must verify the date of the thread before posting. I believe that legally they cant tell u who is making these allogations because being able to make anonymous tips/reports is what makes ppl feel comfortable giving that kinda info without fear of retaliation. However, anonymity wasnt put there to protect the rights/privacy of sumone who isnt doing this in the best interest of the child type way, they are doing it in a vandictive way to cause u greif. U should contact legal aid cuz u are goin to need a lawyer to help u. If all these claims keep comin back unfounded, ur lawyer just has to get a judge to sign a legal eyes only warrant to see ifthe same person or number is making the false complaints. If so then they can add all the info up and not only will u be pressing charges on this person but ur department of child and family services probably will be too.. good luck
