Few years ago I applied for E-2 investor Visa and has been approved for 1 year from August 2005 to August 2006 (valid 'till 2008) but it expired because I came in and left the Country before 2008. Anyways in the meantime I needed my son's help in my company and I applied also for him and he has been approved for 5 years from July 2006 to July 2011.

Now I sent all my documents to the consulate in my Country (Italy), asking for the extention of my expired visa, they replied saying that it DOES NOT EXIST any EXTENTION of visa, but visiting the http://usimmigration.visapro .com I found that it DOES exist the option called E-2 EXTENTION -
My question is: Does the VISA E2 EXTENSION exists?

How is it possible, at the moment my son (under my company) has a valid E-2 visa 'till 2011) and I, as a president and owner of the company, do not have any anymore, isn't it odd?

Hope you can explain me what is going on.

Thank you!

The extension only exists by filing with the USCIS Service Center in the US. However, even if and when that is approved, that only extends your status while you are in the US. As soon as you depart the US, you would have to go through the consular interview all over again for the new E-2 visa despite having done the extension in the US. However, simply sending the documentation to the Consulate directly does absolutely nothing for you because they have no jurisdiction to review or adjudicate anything unless you are in front of them and applying for a visa.
