For years I maintained a wireless account with AT&T. When my wife became ill I added a second line to my service in case she needed to contact me when I was away from home. The second line came with a three year contract extension. Complications following my wife’s kidney transplant made it necessary for us to move to Arizona. When I inquired about moving my wireless account to Arizona I was told AT&T did not support service in my new town. Not only did they not offer service, I could not purchase AT&T wireless service from a billing address with that zip code. I was told my account could be put on hold in case AT&T brought service to the area.
Because of my wife’s health, we were forced to subscribe to a wireless company that provided service to our area and incurred a two year commitment with this company. My wife died last Spring and I was forced to pay a fee to discontinue her number with this company.
Last Fall I received a letter from AT&T informing me my service was to be restarted. I wrote and explained AT&T service was not available in my area and, because of the circumstances, I asked that my service be discontinued. I received no answer, just more bills. I wrote two more letters and have still not received a reply. I finally received a letter indicating my contract runs through June, 2006. AT&T continues to bill me and, although I haven’t used the service I have somehow run up quite a tab in addition to the penalty for early termination of my contract.
Am I obligated to pay AT&T for early termination of my account after moving to an area where they will not provide service?
