Can an employer take earned leave as a mean of disciplining an employee?

You need to explain further. What do you mean by "earned leave"? Paid vacation time?

And what do you mean by "take"? Cancel vacation time previously scheduled? Or actually take days or weeks you are eligible for under a company policy out of your vacation/paid time off bank?

Understanding the circumstances surrounding why your employer would consider doing this as a disciplinary measure might help too.

Earned leave = Accrued paid time off. Given to employees as outlined by the company's policy. (When you work, you accrue leave)

Take = Yes actually take days or weeks.

The employer does this for what they consider serious violations in company policy. For example insubordination, being late too many times, not doing the job properly, etc.

Gimme a break, Smitty. I'm in the process of moving my office and all my state law stuff is packed in boxes. :)

To the best of my knowledge, in DC this would be legal. I won't be 100% certain, though, till I can access some of my source material, which is why I hadn't responded yet.
