Hello i live in TN and i plan on buying a new mobile home to replace the one i have now. Current mobile home is in compliance with the easement that effects me and many others including my neighbor across the street. Around four years ago i was told by the easement holder (Co.) that i could not move any further over where current mobile home is located but i could move it over the opposite direction as far as my property line.. The Co. employee also stated the mobile home across the street was in violation of easement and would have to be moved. What should i do about this as it's not fair for the Co. to discriminate against me and allow others to blatantly be in violation of easement. The only thing i know to do is get the Co. to tell me in writing that i cannot move home where i would like and sue the Co. as the rep i talked to and informed me was the one who handles easement violations and it's been over 4 years since others have been in violation. Thanks in advance...

First, what does CO mean? County or company or what? If its a company what kind of company? Also, what is the easement for? Utilities, ingress and egress or something else?

Since you mentioned being in a mobile home Id like to ask if your in a manufactured housing community - mobile home park where you rent your lot and if you are has your landlord ever used any kind of map of the grounds that shows exactly where this supposed easement is in relationship to the towers / pylons / poles or any other way of having it marked out so tenants know where their lots end as well as where this supposed easement begins rather than just relying on what a utility employee says ?

Adding a new structure in violation of an existing easement is different from having a structure existing at the time an easement is granted.

It is possible that fines have been assessed against your neighbor or perhaps your neighbor was granted a variance.

Whatever the case, it is rarely a good idea to base what you do (or what you think you can do) on what "everyone else" is doing. Whatever is going on with your neighbor and TVA's easement, it really has no bearing on your own structure and its placement on your property.

You have been informed that moving a new mobile home to your proposed location would violate TVA's easement. You can perhaps ask for a variance but, as it appears to currently stand, moving a new mobile home onto your property should be done with an understanding of the limits placed on you by TVA, and an understanding of the possible consequences of ignoring these limits.
