According to my deed there is a permanent 10'easement on my western border so the people who own the land behind me can get to and from their land. A lady developing that land has put in a paved road to their land and has it written in their deed that they are permitted to use the paved road for that purpose. She has also blocked off my easement on her side with big logs so ATVs cannot get through. Since the purpose of my easement was to give them access to their land, and she has provided that with the paved road across another easement she purchased, I would like to fence in my easement as part of a horse pasture. Will I be allowed to do that? Was she within her legal rights to block off my easement on her side of the property line, thus eliminating the use and purpose of my easement. Does that give me the right to have my easement as part of my horse pasture, or must I still leave this open? I live in Polk County in NC.
