What is the name of your state (indiana)?

I am a disabled vet [60%] and recently divorced. I previously had a successful online business which is now only making about $1200 mo. My 3 teen boys are getting near college age [HS senior. junior, freshman] and my former atty tells me I am responsible for paying a 1/2 share of my kids college expense... even though i can't afford it. What happened to kids taking responsibility for their own education. Not that I wouldn't want to pay if I could afford it. I paid for their private school education from the 6th grade forward.

How can the state of Ind require divorced parents pay for college and married don't? My sons will get their tuition waived if they attend a state university as part of my ind state veteran benefits. is this considered part of my share?

I'm confused and am not sure my former atty was telling me the truth since she was vague in what I actually owe. I also don't understand support being paid till 21 yrs of age...What is the name of your state (only U.S. law)?

How is support actually addressed in your divorce decree/orders?

And, if you were disabled AFTER the decree, file to modify it based on what you are now able to do, change of circumstance.

I was disabled at time of divorce and the income was considered in support.

The education issue was not addressed in mediation because I believe BOTH attys want more activity/money later. I also gave wife more cash at settlement to keep support payment lower which i'm sure her atty told her can be amended later. We do have about $35,000 in an education fund which will probably delay the confrontation until 2011 or 2012.

I will be on SS in 2014 and still owe child support to ex for a 20yo. That sucks!

Just for the record, in Indiana child support goes to age 21 or emancipation, whichever comes first. Being in college is NOT emancipation in Indiana.

In Indiana it is by no means guaranteed that a parent will have to contribute to college expenses. However, when it is ordered, then the traditional order is that AFTER all grants, scholarships and student loans are utilized, that the remaining expenses are 1/3 mom, 1/3 dad and 1/3 child.

A parent can get away without having to contribute to college expenses (or not having to contribute much) by fully cooperating with the student loan/grant/scholarship process. Quite a few parents hurt their own cause by not fully cooperating with that process.
