What is the name of your state? Florida ......What are the penalties if an elder wants to give monies and assets (property) to the children before seeking permanent residence in a nursing home? Could both the parent and the recipients be charged?

Considering they look back several years you cannot avoid being caught if you plan on "spending down" So it is better to follow the rules. Consult a qualified financial planner/estate attorney to learn your legal options and you may contact your local senior services regarding available resources to assist your family in the care of your loved one. Remember, there is responsibility for their care, it is not the state's responsibility to provide care for your loved one so that you can maximize your inheiritance.
