Hi, i was at an elizabeths pizza the other day and my boyfriend ordered a calzone. 3/4 of the way through he pulled what looked like a metal bristle from a grill brush out of his mouth that had punctured his gum. we told the waitress who took the metal and got the manager... he comped our meal and we left. Other than a little pain for the rest of the day my boyfriend is fine and did not go to the hospital... do we have grounds to sue?

Sue for what?

Clearly, your boyfriend did not suffer any significant medical issues resulting from his contact with the hazard. He didn't go to the hospital, and other than a little pain, you say he was fine. As for you, you don't even say you were injured at all.

You guys DID NOT win the lawsuit lottery here. You got your meals comped by the restaurant. What else were you expecting?

Yes. You have grounds to sue. However, lawsuits are meant to compensate people for what they lost. They measure what was lost in money and call them "damages".

What were the damages?

Not much. Besides, you already got the meal for free.

but but but I don't see why I don't deserve something, after all, I got poked and it bled for a good 5 minutes...maybe even 6.
