If my ex-wife refuses to let me see my daughter next weekend during my Court appointed visitation schedule, I understand that I have the right to have my lawyer file an emergency petition to find my ex-wife in Contempt of Court. I sent her a Certified Return Receipt letter on Jan 5, 2001, stating the dates and times I would pick up and return my daughter -- all in accordance with our visitation schedule.

My daughter is ten-years old. I anticipate my ex will deny me visitation because she will say my daughter doesn't want to see me.

Will her arguement hold up in Court?
How much does an emergency filing cost?
How long will she be in jail?

you need to tell us what state you are in. It will cost whatever it is your attorney charges you file the motion,
although you are able to fill such motions yourself. Your
ex will not go directly to jail, if she is found in contempt it will go in the case file and the judge will advise her not to continue this behavior. You are entitled to visistation with your kid unless there are extenuating
circumstances that your ex can prove to the judge. A child
not wanting to see the father is not one of them. Good Luck
