employee vs. independent contractor

Ok here is how the situation goes. I filed a Form with the IRS to do a determination to see if I am a employee (which I feel I am) vs. Indpendent contractor. My question is If the determaination comes back in my favor can I ask for all holiday pay and vaction time I would have had had they put me on payroll for the years I am determined for?
Basically I applied that the years 01,02,03 And will file for this year also. That would be 3yrs of Holiday pay 3yrs of vacation pay. Can I get it if the IRS determines i am a employee?

You can ask. But whether you will get it or not is another story.

Nothing in the law says that you are entitled to either vacation pay or paid holidays, regardless of whether you are an employee or not.
