What is the name of your state (only U.S. law)? Pennsylvania

I have a question. I left my previous employer and gave them 2 weeks notice. I had an exit interview with HR and nothing was discussed about final paychecks or owing them money etc. Now they did give me tuition reimbursement and the form that is used for reimbursement says that if I leave within 12 months of payment the money is "recoverable" by them. My question is is that legal for them unannounced to just take my final paycheck? I thought theonly thing a paycheck can be attached for is taxes or child support? They are entitled to the money but I thought they would have to bill me for it and not just take my check for hours worked and not even discuss it with me?? Please help??

If all the agreement says is that the tuition is "recoverable" then that is not specific enough to authorize a deduction from your pay. If they take it from your check, file a complaint a complaint with the PA Dept of Labor and Industry.

I would firmly explain to them that you have never, and are not now, authorizing a deduction from your wages and also show them this.

Until the poster answers my question, it is not clear whether that is what they did or not. PA is NOT one of those states where final pay is due on the last day of work.

It was not a wrongful termination. I left on my own and gave two weeks notice. the question here is are they authorized to keep my final paycheck for hours worked when the agreement for tuition reimbursement only says the monies are recoverable???

My last day of work was March 9th, my final pay was on March 15th and they took almost the entire check for tuition payment back to them. I feel this was done in a non legal fashion.

You say, almost the entire check. Does the amount that you did receive constitute minimum wage times hours worked?

What did you sign when you agreed to repay the tuition reimbursement? Was there any kind of authorization included?

No it was not close to minimum wage. I received 11 dollars for 6 days of work. I did not sign anything. When you submit paperwork for tuition reimbursement it is a form that says on it the amount is recoverable. that is all it says. I did not authorize any deduction of my payroll for this. I think it was wrong for them to do this without authorization. I want to know what my options are??
