My employer is going to deduct from my vacation time for the period that I was unable to work due to Hurricane Ivan. My employer is located in Long Island and I work from my home via an IP connection. We were out of power for 6 days (not bad considering what some people are going through).

Do I have any legal recourse? I was hoping the fact that the area was declared a National Disaster Area might give me some legal footing to stand on.

Do I have any legal recourse? Nope. Your employer is free to attribute your "down time" to your vacation benefit if they wish to.

I was hoping the fact that the area was declared a National Disaster Area might give me some legal footing to stand on. That has to do with federal funding being available to the State/counties. It has no impact whatsoever on your employer's policies.

When Tropical Storm Allison flooded all of the Houston area in 2001, the area was declared a "Presidential Disaster Area". Thousands of people, including myself, were not able to get to work for over a week (flooded roads, debris, cars destroyed, etc.). So, the state made unemployment funds available to qualified individuals that were unable to get to work. Maybe this will be available to you as well. Good luck.
