Employer Didnt pay me the payments on time.

I got a contract employment with a Company X and they have hired me to Company Y. Due to a personal reason I wanted to resign after two weeks. As per the agreement I gave them a two weeks notice. Then Company Y didnt want me to stay with them for two weeks. They released me in a one week time. So I totally worked for three weeks.

I have faxed my timesheets on time to company X after getting signed from Y. Company X was supposed to pay me twice a month keeping two weeks delay. They didnt pay me any amount of money for the work I have done. (ALmost 3weeks time - around $3000.00)

They were supposed to pay me on 1st December and 15th december. Now the company X claims that they cannot release my salary until they get it paid/approved from company Y. These conditions were not there in the agreement. ANd also I Dont know whether they are getting paid from the company Y or not. Now they are talking about insufficiant notice. I gave sufficient notice (ie. 2weeks) they were okey with that at that time.

What can I do ?
 


Your employer has an obligation to pay you whether or not the company you were contracted to pays them. If you feel you are owed compensatin, contact the IL Dept. of Labor and file a claim.

Doubt in the employment agreement

In the employment agreement, there is a quote

"Contract Employee's final check is predicated upon the receipt of
billing for services rendered being received from client by Company X. At
termination, if there are any outstanding company loans or dues not fully repaid by Contract Employee to Company X, the Contract Employee is responsible for full payment of said dues at completion of Contract Employment. Final paycheck may be adjusted to reflect deduction of any outstanding amount due to Company X by Contract Employee"

I'm expected to have two payments. So I think I should not wait till the Complany X get the money from the Company Y to get the 1st Pay check.
And may be for the second payment I may have to wait. Is this correct ?

I'm confused. Please clarify.

Does this make a difference of the right for complaining for the wages ?
Any thoughts ?

They cannot hold your pay pending receipt of payment from the contracting company. I'm pretty sure Illinois would consider that an unenforceable requirement and, in fact, a violation of Illinois labor law. As SuzWahoo suggested, file a claim for unpaid wages.
