I have a situation with my employer and disa( disa is a company that handles drug screens for about 90% of the oil and gas industry). The first time I tried to get a job at this company I failed the pre-employment drug screen so I had to go through rehab and wait 6 months before I could get back active in disa's system. I completed everything I was suppose to, the same company gave me another chance and hired me. Well last Thursday morning at 8:44am I got a phone call that I needed to go pick up paperwork and go take a drug test and I had 60 min to get there. I told him that I wasn't sure if I was gonna be able to pass it cuz I took two pain pills on Tuesday, which was my days off from work. He told me I had two choices either go take it or refuse it. So I told him that I was headed that way and I would go and take it. On my way there he called me and told me don't go to the collection site just come to the shop that I was fired. Now I never refused the test and was going to make it there in time. When I got to the shop they has me sign some insurance cancelation forms but I never signed a refusal form that is required for disa. I thought because I was being fired that I didn't have to take the screen anymore and no one told me any different. I have all this recorded in text messages from my manager. they told disa that I refused the test which puts me inactive for 3 years( I can't get a job with any company that deals with disa pretty much every company that does the same work I do) I was also fired they say for being unable to take drug screen. Which is also a lie. From what I understand they can fire me for any reason. But they lied to disa about the refusal do I have a case against them to get back active in disa because if not I'm blacklisted for 3 years from earning a livening in what I have been doing for 10 years. Thanks for any help
