I have to have surgery and have been with company for 4 years. I asked my Manager to provide me a resource to apply for FMLA because I will be out for 10 weeks. He advised me that I have to send restrictions before procedure, after procedure and send actual name of procedure being done before sending me FMLA paperwork. I don't understand this process and not sure why I have to send all of this information to them first when the information will also be disclosed by the Dr in the FMLA packet. I feel like I am being pushed out of my company but I love my job and the people in it. I have never been in trouble and received several promotions within the last 2 years. Do I have any legal recourse? I know louisiana is an at will state, but I am currently disabled. Does that count for anything? Should I go straight to HR? I don't even have their number. ;(

There is no law stopping the employer either within the FMLA or otherwise from making what they are asking for a requirement.

Legal recourse for what? Your post doesn't suggest any legal wrong has occurred or is likely to occur.

I know louisiana is an at will state, but I am currently disabled. Does that count for anything?

Telling us that you're "disabled," without any information about the disability, when you're obviously able to work full-time, is all but meaningless.

Should I go straight to HR?

Sure. Why not?

Sorry I was not clear. I need a total hip replacement and my company will not send me the FMLA paperwork. They asked for restrictions and procedure info before releasing the FMLA paperwork. I honored their request and they will not send paperwork nor will they let me on property due to my non-work related injury. If they were to terminate me after I asked to be placed on FMLA, do I have any legal recourse? I thought by law they had to honor FMLA if i am eligible. I have already been told that I have met the criteria. I am not permanently disabled but currently disabled at the moment. I hope this clarifies things.

Go to HR. Go directly to HR. Do not pass Go, do not collect $200.
